Fully open D&D/UO Hybrid/Open Mmorpg

I'm sure this has probably been out before, but my idea was to have a "Fully" open Mmorpg. with D&D and Ultima Online "like" rules, as in, rolls, stats, etc. (Based of the same principle, but I don't want to get into any legal trouble)
ie: You roll a 10 to hit, and you need to roll a 5 or more to hit, so thats a confirmed hit, but have 1 skill, so you hit for 2 dmg , and as you gain in a certain skill, your minimum to hit rises, but will never be 100% on its own, unless you own some very special items
Basically, There are a few rules/idea's to the game
First off, the setting is in a fantasy/medieval time. There will be one main antagonist, and several sub antagonist's if that even makes sense. each region will have main raid type kings/demons/etc that rule that territory. each region has no alliance with each other as of yet.
1: You would have the option of attacking any npc, player, monster in the game.
Npc's such as merchants can have bodyguards that will attack you obviously, and be pretty strong, but not superhuman. Everything the npc is wearing, would be lootable upon death (accept his actual items for sale, which of course, would safely tucked away in his chest), and would respawn at a certain time of day. Guards would of course be very VERY tough to beat, and players obviously will be the hardest time killing them, but it will be possible, granting you a nice set of armor and weapons, but a very bad reputation in town .
Now, if you attack anyone in town of course, guards will be called, and rush towards you to kill you. Where in you have a few minutes to reach your body before it becomes lootable to anyone who was in the area. (There will be an option to soulbind items, perhaps from a mage or cleric for a few silver) The penalty for killing players or npc's in town will be severe, so limit attempts.
Killing players or npc's that are out of the area will not grant you any faction hit, because who will be there to see you do it? But you will suffer karma loss if it was an unprovoked attack.
Another example would be stealing in game. You would have a
2: Completely skill based classes. You start off with basic spells (weak) and some skills. Once you reach a certain skill lvl you are given the option to have a class title, ie: Theif/Mage/Warlock/etc. Yo may also create custom title's at a certain level for a fee to be determined at a later time, ie: Volfarin the Famished (Gm will set title)
3:Npc AI (if possible) would have them killing other npc's monsters of the opposite faction if they wander in the same area. The npc will also "loot" a random item from that npc, and can gain skill (in lower player area's) to a certain degree before being killed, looted, and respawned, starting the process all over again.
An example would be NPC: A Thug, kills wolves in the newbie area when they wander too close to camp, loots them, skins them, etc. PLAYER A kills NPC: A Thug and loots thug, getting the loot he accumulated. Now, the npc's will have a small inventory space, and a weight limit, as to prevent super loot npc's. This would also provide a way for a regular npc to receive a NPC title, or also known as "A Named" mob.
Like that same thug, gets up to 50 skill in daggers, and 50 skill in skinning. He is now elligible for the title "Stitches, the Wolf Slayer" (There could be a ruleset, or script where npc's can turn into certain rare named based on skills aquired.) This would be a fun way to have special named mobs appear instead of having the same static named npc spawn after killing abc mob, or placeholder.
4: The actual "skill" limit will be very high, as in, you can master up to 10 skills maybe more, to create classes that are unique and normally unavailable in regular mmo's. Like a a mage with pickpocketing skills, and a master cook, etc. Once a skill reaches a certain lvl, you can purchase other skills from the trainer npc, located in town, or on some high mountain far off in distant lands.
5: Race would be open to almost all available in game, but don't expect to be welcome everywhere.
Each race will have a slight benefit when created, but nothing that cannot be eventually aquired by any other player.
6: Most "wanted" items will be player made. Besides the regular iron/steel type crafted weapons, players will be able to combine properties of looted weapons into their own items
ie: Player ! with 75 swordsmithing attempts to combine Mooninite (hehe) ore with +1 Flaming Longsword
making it into a +1 Longsword of Lunar Flare which adds so and so fire dmg and does extra dmg to holy creatures. Items can also be enchanted with certain spells by a player with skill in enchanting. I can expand on this alot, but its the basic idea.
This is basically the biggest part of the idea, I know there are ALOT of implementations to think about, but its just a general idea. BTW if anyone wants to take any of these idea's and incorporate them into their own game, feel free. What do you guys think?

Make sure you have a solid banning/kicking method, and have some solid code review done as well. A free playground will attract a plethora of asshats. And not having anything at risk (loss of subscription, legal repercussions) will only tempt abuse.

I was thinking of something in the lines of a PK timer, once killed, you can no longer be attacked for 2 hours game time as "the gods" have a watchful eye over you, and you cannot be harmed by the same players or anyone in his group/guild during such attack.
Constant abuse (Player harassment, exploiting, etc) would result in jailtime/character locks. Maybe even having the players toon transformed into a chicken for 30 days with 1 skill in "pecking" (max 10 skill) and all the skills set back to 0, inventory wipe depending on severity.
Severe abuse would call for character deletion, in which all the abusers items would be spilt onto the ground for anyone to pick up, and the character wiped from the game. Ip will also be banned, as well as the MAC ID of such computer.
So if they really wanted to, ty could get a new ip, and spend money for a new NIC card, and be an asshat all over again, only to be IP Banned and MAC ID banned all over again, I can even go farther, but we will leave it at that.
Minor abuse would call for temp bans, maybe a temp chicken transformation might do the trick too. I want this to be a fun game, and I want to keep people playing it (once its made)
what do you think? too severe? or am I being too nice?

I'd like to work with you in this project. I am illustrator/concept artist, and work with 3ds max and Zbrush too. So if you want i can help you in this game. I have to say that i am a benigner in the videogames world but i'd like to work, so if you think that i can help in any thing, please post here.

At the least I would require a valid email address from their ISP and not free email services. Then you can report them to their ISP as most ISPs have terms of use type services. Then you can get nasty and ban their IP and MAC if that does not work.
Another take would be to have trials in game. Set up a trusted group of individuals to act as lawyers, judges, etc. Bring in witnesses, have a jury, etc. This would be an interesting social experiment as well. The judge could be you are one of selected esteemed members that are voted into office. This could be quite fun even though the reason is not so fun. There could be sentencing like jail time, burning at the stake, hanging, lashings, forced to pay fines, etc. Yes, you could have a wizard turn them into a chicken too.
What such a system would eliminate is false accusations by a group of Asshats. The trials don't have to be long and they could be stopped at any time, but it would be a great forum for allowing the "user conduct" clauses to be referenced. You could send notices that a trial is to be held for the accusations against "whoever" at such and such time at such and such location for the crimes of such and such. The notices could be sent by email to all involved and to jurors if they are used. It would all be voluntary for each user of course.
Anyway, something to think about. Maybe you will come up with a better version of todays court systems in the process. It might be kind of fun to play Solomon.

IPs and MACs can be spoofed easily. It would really suck to the guy who had their IP and MAC spoofed. I know there is no perfect way to do this kind of stuff and IP and MAC would most likely work, but if you used MAC and IP it would require most people to replace their broadband routers rather than their NIC. My router only reports the MAC and IP of the router.At the least I would require a valid email address from their ISP and not free email services.
